Terms of Service
Effective May 12, 2026. By creating an OscarMike account, you agree to these terms. Please read them. If you disagree with any part, do not use the service.
1. The Service
OscarMike (https://beoscarmike.com) is a service of TECHPOINT FRONTIER LLC ("OscarMike," "we," "us," "our"), an SMS-based dispatch platform for field service businesses. When you sign up, you receive one dedicated US phone number that acts as an automated dispatcher for your team. The platform uses AI to classify inbound messages and coordinate your team automatically — logging jobs, dispatching technicians by text, and emailing invoices to customers.
The service is intended for legitimate business use by licensed or registered field service operators (HVAC, plumbing, lawn care, irrigation, electrical, roofing, and similar trades).
2. Accounts and Eligibility
You must be at least 18 years old and authorized to enter into contracts on behalf of your business to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3. Subscription and Billing
Billing begins on the date your account is activated. Subscriptions renew automatically each calendar month. You authorize us to charge your payment method on file for each renewal until you cancel.
All fees are in US dollars. We do not offer refunds for partial months. If a payment fails, we will attempt to retry and will notify you; accounts with sustained payment failure may be suspended.
4. Cancellation
You may cancel your subscription at any time through the customer portal. Cancellation takes effect at the end of your current billing period — your service remains fully active until then. We do not prorate or refund unused time.
After cancellation, your dedicated phone number will be released and your account data will be retained for 90 days before permanent deletion (see our Privacy Policy).
5. Acceptable Use
You agree not to use OscarMike to:
- Send unsolicited commercial messages (spam) to any person
- Harass, threaten, or abuse any individual
- Violate the Telephone Consumer Protection Act (TCPA) or any applicable federal, state, or carrier messaging guidelines
- Impersonate any person or organization
- Transmit illegal content or facilitate illegal activity
- Resell or sublicense access to the platform without our written consent
You confirm that any technician you add to your account has agreed to participate before you add them. Each technician confirms their own mobile number through a one-time verification link, where opting in to SMS is optional — a technician may decline SMS and still be part of your dispatch team. Customer-facing communications such as invoices, receipts, and follow-ups are delivered by email — not SMS. The platform sends SMS only to team members on your account who have opted in.
6. SMS Messaging Program
OscarMike operates an SMS messaging program — OscarMike Dispatch Alerts — that sends operational text messages to the people on a business account: the owner and admins, and the technicians they add who have opted in. Messages include job assignments, dispatch and routing notifications, job-status updates, schedule changes, and account or billing alerts. We do not send marketing or promotional texts, and we do not text your customers — customer-facing communications such as invoices, receipts, and follow-ups are delivered by email or handled by your own staff.
SMS messaging consent is optional and is not required to create an account or use OscarMike. Operational features that rely on SMS will only function for users who opt in to messaging, but account creation and access to the service do not require SMS consent.
Message frequency varies with your dispatch volume. Message and data rates may apply.
For help, reply HELP to any message or contact us at hello@beoscarmike.com. To stop receiving messages, reply STOP at any time — we honor opt-out requests immediately, and you will not be re-messaged unless you opt back in. You must not attempt to re-message anyone who has opted out. See our Privacy Policy for how we handle your information.
7. Account Termination
We reserve the right to suspend or terminate your account immediately, without notice, if we determine that you have:
- Violated carrier messaging guidelines or the TCPA
- Used the service to send spam or harassing messages
- Engaged in any activity that puts our Twilio account or phone numbers at risk
- Otherwise materially breached these Terms
In cases of termination for cause, no refund will be issued for the current billing period.
8. Service Availability and Limitations
We strive for high availability but do not guarantee uninterrupted service. SMS delivery depends on third-party carriers and Twilio — we are not liable for:
- Delivery failures caused by carrier filtering, network outages, or Twilio service interruptions
- Message delays caused by factors outside our control
- Inaccurate intent classification by the AI dispatch engine
You should not rely on OscarMike as the sole means of communication for safety-critical operations.
9. Intellectual Property
OscarMike and all associated software, design, and content are owned by us and protected by applicable intellectual property law. You retain ownership of the business data you bring to the platform (customer records, job history). You grant us a limited license to process that data solely to provide the service.
10. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be error-free, uninterrupted, or that results obtained from using the service will be accurate.
11. Limitation of Liability
To the maximum extent permitted by applicable law, OscarMike shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or loss of business opportunity, arising out of or related to your use of the service — even if we have been advised of the possibility of such damages.
Our total cumulative liability for any claim arising under these Terms shall not exceed the amount you paid us in the three months preceding the claim.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the service shall be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via SMS or email at least 14 days before the new terms take effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.
